Store Returnd Policy

(Regulations in force from 06 October 2010)


§ 1

1. These regulations (hereinafter “Regulations”) specify the rules of sales and returning Goods in House Stores binding for all Consumers.

2. The sales governed by these Regulations will take place as from 06 October 2010 until the information on repealing the rules of sales and return of goods specified below is announced publicly (in compliance with Article 7 hereof).


§ 2

The terms used herein shall have the following meaning:

1. Organiser – LPPS.A.with its office Gdańsku ul. Łąkowa 39-44

2. Sales governed by these Regulations – each sales contract concluded with a consumer on the basis of which the Consumer purchases Goods at a House Store located on the territory of theRepublicofPoland.

3. Goods – clothes and other goods which create or supplement House brand fashion styles and trends currently offered by a specific House Store whose sales is subject to these Regulations.

4. House Store – a Store located inPolandwhere the Goods are sold and listed on the website: www.house.pl.

5. Consumer – a natural person aged 18 and above (or a natural person aged 13 (thirteen) with the consent of their parents or caretakers, unless such consent is not necessary in the view of effective laws) who accepts these Regulations and the Sales rules included therein and is a person purchasing the Goods in a capacity of a consumer in the meaning of commonly binding laws.

6. Outlet Store – a Store located inPolandwhere the Goods are sold, which is listed on the website www.house.pl and marked as an outlet store.


§3

The sales governed by these Regulations shall take place at House Stores located inPoland, a list of which is provided online at www.house.pl, in their opening hours, except for Outlet Stores.


§4

The following rules shall apply to the sales and returns governed by these Regulations:

1. AConsumer has the right, but not the obligation to use the sales and return rules included herein, as well as all the rights awarded to them under these Regulations.

2. The following rules shall apply to the sales and returns governed by these Regulations:

a) each Consumer has the right to return the Goods purchased at a House Store within the period of 30 days from purchase (i.e. from the day following the date disclosed on a fiscal receipt as the sales date);

b) The Goods the Consumer intends to return hereunder:

- cannot bear any traces of use, in particular cannot be damaged mechanically and cannot have any other, even small, physical defects,

- must have all the markings (including labels) attached by the seller at the point of purchase permanently fixed. Such markings must be original (i.e. must come from the seller) and cannot bear any traces of removal and re-fixing to the Goods,

- Goods which had a specific packaging at the moment of sales (e.g. shoes) should be returned in the undamaged, original packaging,

- Goods whose price at the time of sale was decreased due to physical defects, damage, decreased value characterising the Goods cannot be returned. 

c) The following Goods offered for sale at House  Stores are not subject to sales and return hereunder:

- Underwear

- Swimwear

d) To take advantage of the return rules referred to herein, a Consumer should go in person to any House Store located in Poland (except for Outlet Stores) and present and serve on the seller the original fiscal receipt issued at the moment of purchase of the returned Goods and return the goods compliant with the requirements specified in Article 4.2(b) hereof to the seller, and in the case of a payment card payment, also the printout confirming the transaction.

e) Should the seller conclude that in a specific situation the Goods may be returned in compliance herewith, the seller shall take the Goods from the Consumer together with the fiscal receipt issued at the moment of purchase and will return to the Consumer the amount equal to the price paid by the Consumer at the time of purchase of Goods. The return of the price paid by the Consumer at the time of purchase takes place only and exclusively on the same rules on which the Consumer made payment at the moment of purchasing the Goods, i.e. if the payment was made by a payment card, the sale price is returned only and exclusively to the Consumer’s account with the use of the same payment card (i.e. the one used to pay for the purchase), if the payment was made in cash, the Consumer receives the return in cash.

f) In the case of any doubts as to the application of the rules of Sales governed hereby, in particular doubts as to the fact whether a particular item of Goods is subject to these Regulations, the opinion of a House Store Manager is decisive.

g) Failure to notify about the will to take advantage of the possibility to return the Goods (on terms and conditions specified herein) in the period of 30 days from the date of purchase means that the Consumer has resigned from the possibility to take advantage of the rights awarded to them hereunder. In this situation, as from the lapse of the deadline referred to in the preceding sentence, the Consumer finally loses the possibility to take advantage of their rights hereunder with respect to the Goods as to which the period referred to in the preceding sentence has lapsed.


§ 5

1. Before the purchase of Goods the Consumer should make sure whether the Goods they intend to buy are subject to sales hereunder, i.e. whether in the case of submitting a request to return the Goods in the period of 30 days (on the terms and conditions specified herein) they will have the possibility of return on terms and conditions specified herein.

2. AConsumer intending to take advantage of sales and returns governed hereby has the right and obligation to familiarise themselves with these Regulations which are made available for viewing at all House Stores whose sales are governed by these Regulations.


§ 6

The information on sales governed by these Regulations is not an offer or public promise. The Organiser shall not be held liable for defective or incomplete interpretation of the slogan of sales covered by these Regulations.


§ 7

The Organiser has the right to cancel or shorten the period of the rules of sales governed by these Regulations without specifying any reasons by placing written information at House  Stores.


§ 8

The rules described herein are without prejudice to the pursuit of Consumer’s claims on the basis of the act of 27 July 2002 on special terms and conditions of consumer sales and amendment of the Civil Code (Journal of Laws 02.141.1176). 2. 2. The basis for potential complaints as to the Goods resulting from the non-compliance of the goods with the contract in the meaning of the act referred to in the preceding sentence is the evidence of purchase of Goods at a specific House Store.


§ 9

The Consumer is obliged to submit all the potential complaints related to the course of sales governed by these Regulations in writing, in the period of 3 days from the date of an attempt to return the goods, to LPPS.A.with its office inGdańsk, ul. Łąkowa 39/44 for the purpose of examination of the legitimacy of the complaint or request.


§ 10

The Organiser may amend these Regulations, especially with respect to the increase or decrease of the number of House Stores covered by the sales, and also with respect to amendment of the sales rules. The amendments are effective as from the date of placing relevant written information at House Stores.


§ 11

1. The Organiser shall not be held liable for any potential disputable issues arising for reasons for which third parties are responsible.

2. The Organiser shall make these Regulations available at all House Stores covered by sales referred to in these Regulations.

3. All disputable issues related to the sales governed hereby shall be settled by a substantively competent Court for the Organiser's office, unless absolutely binding provisions of law stipulate otherwise.
